Terms of Service

1. This agreement

These terms are an agreement between you and ACKPlus Solutions Private Limited ("ACKBiz", "we"). They cover ACKBiz Inventory, the web app a shop uses to manage its products, stock, purchases, sales, customers and money, and the ACKBiz Catalog, the public pages where a shop shows its products. By creating an account, or by using a catalog, you agree to them. If you use ACKBiz for a business, you agree on its behalf.

2. Your account

• Give accurate details when you sign up, and keep them current.
• Keep your sign-in to yourself. You are responsible for what is done with it.
• You decide who in your shop gets an account and what each role may do, and you are responsible for what they do in ACKBiz.

3. Your records are yours

The records you keep in ACKBiz belong to you. You allow us to store and process them only as needed to provide ACKBiz to you. How we handle them, and how to have them deleted, is in the Privacy Policy and on Delete your data.

4. Your public catalog

Nothing is public until you publish it. For what you publish, you are responsible that:

• the products, descriptions, prices and photos are yours to publish, accurate, and lawful to offer;
• you answer the questions visitors send you, and use their name, phone number or email address only for that;
• you follow the laws that apply to your shop, such as those on consumer protection and tax.

We may hide a catalog or a product that breaks these terms or the law.

5. If you are a visitor of a catalog

Each catalog is published by the shop named on it. ACKBiz does not sell the products, is not a party to anything you agree with a shop, and does not check a shop's products, prices or availability. A question you send goes to that shop.

6. Connected services

You may connect a service of another company, such as Meta, to ACKBiz. You then allow ACKBiz to act for you on what you chose to share with it, for example keeping your product catalog there up to date. Your use of that service stays under its own terms, and what it does with your products is decided by it, not by us. You can disconnect it at any time in Settings, under Integrations.

7. What you may not do

• Use ACKBiz for anything unlawful, or to offer anything that is unlawful to sell.
• Try to reach another shop's records, or get around the limits of your role or plan.
• Disrupt ACKBiz, test its security without our written agreement, or copy catalogs in bulk by automated means other than ordinary search indexing.
• Resell ACKBiz, or offer it to others as your own, without our written agreement.

8. Plans and payment

Where a plan is paid, its price and period are shown before you pay, and payment is taken by our payment provider. A paid plan runs for the period you paid for.

9. Availability and changes

We work to keep ACKBiz available and your records safe, and we back the database up every day. We do not promise that ACKBiz will never be interrupted. We may add, change or remove features; when a change takes away something you rely on, we tell you beforehand where we reasonably can.

10. ACKBiz is a tool, not advice

ACKBiz works out totals, taxes and balances from what you enter. It is not accounting, tax or legal advice, and you are responsible for checking that your invoices, taxes and filings are right.

11. What we do not promise, and the limits of our liability

ACKBiz is provided as it is. To the extent the law allows, we give no warranty that it is fit for a particular purpose or free of errors.

To the extent the law allows, we are not liable for indirect loss, such as lost profit, lost sales or lost data, and our total liability for a claim about ACKBiz is limited to what you paid us for ACKBiz in the twelve months before the claim arose. Nothing in these terms limits liability that the law does not allow to be limited.

12. Ending this agreement

You can stop using ACKBiz at any time. We may suspend or close an account that breaks these terms, puts ACKBiz or other shops at risk, or is not paid for. When an account ends, its catalog is no longer public, and its records are erased as described on Delete your data.

13. Changes to these terms

When these terms change, the new version is published here with its date. If a change matters to your rights, we tell account holders by email or in the app before it takes effect. Using ACKBiz after that means you accept it.

14. Governing law

These terms are governed by the laws of India. The courts at Ahmedabad, Gujarat have exclusive jurisdiction over any dispute arising from them.
